Press Release - January 27, 2005
On Monday, January 24, 2005, the Rockwall City Council voted to request the Texas Supreme Court to review the decision made by the Fifth District Court of Appeals of the State of Texas regarding The Caruth Estate v. City of Rockwall. The ruling made by the Court found in favor of the Caruth Estate and the City of Rockwall does not agree with the interpretation of state law made by the Court. The Appeals Court opinion reverses the original ruling made by the 382 nd Judicial District Court and interprets state law to determine that The Caruth Estate, as a landowner, is permitted to seek arbitration in the annexation process. The Supreme Court has agreed to review our case. Oral arguments are to held on January 25, 2006.
